1. Agreement to Terms

By downloading, installing, or using the Site Manager AI application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Site Manager AI ("we", "us", or "our").

2. Description of Service

Site Manager AI is an AI-powered construction site management assistant that provides:

  • AI chat functionality for construction-related questions and guidance
  • Document generation including RAMS, method statements, risk assessments, toolbox talks, and other construction compliance documents
  • Site photo analysis for hazard identification and safety compliance
  • Project management and document organisation features

3. Important Disclaimer — Professional Responsibility

Site Manager AI is an advisory and drafting tool. It does not replace the requirement for competent persons as defined under the Construction (Design and Management) Regulations 2015 (CDM 2015) or any other applicable legislation.

All documents generated by the App should be reviewed, verified, and approved by an appropriately qualified and competent professional before use on site. The User bears full responsibility for ensuring that any documents or advice used in practice are suitable for their specific circumstances and compliant with all applicable regulations.

We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for any specific purpose or project.

4. User Accounts

To access certain features of the App, you may need to create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorised use of your account
  • Accept responsibility for all activities that occur under your account

5. Subscriptions and Payments

5.1 Pricing

Site Manager AI offers the following payment options:

  • Monthly Subscription: £9.99 per month, billed monthly
  • Lifetime Access: £150.00, one-time payment

5.2 Payment Processing

All payments are processed through the Apple App Store (iOS) or Google Play Store (Android). Payment terms, refund policies, and billing practices are subject to the terms of the respective platform.

5.3 Monthly Subscription

Monthly subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's app store settings.

5.4 Lifetime Access

The lifetime access option provides permanent access to the App's features for a single payment. "Lifetime" refers to the operational lifetime of the App. Lifetime access includes all updates and new features released during the App's operational period.

5.5 Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies. We do not process refunds directly.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Use the App to generate content that is fraudulent, misleading, or intended to deceive
  • Share your account credentials with third parties
  • Use automated systems or bots to access the App
  • Attempt to circumvent any security features of the App
  • Reproduce, distribute, or resell AI-generated content for commercial purposes unrelated to your own construction projects

7. Intellectual Property

7.1 Our Intellectual Property

The App, including its design, code, features, and branding, is the intellectual property of Site Manager AI and is protected by copyright and other intellectual property laws.

7.2 User-Generated Content

Documents and content generated through the App based on your inputs are yours to use for your construction projects. However, the underlying AI models, templates, and systems remain our intellectual property.

7.3 User Data

You retain ownership of all data, photos, and information you upload to the App. By using the App, you grant us a limited licence to process this data solely for the purpose of providing the App's services to you.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The App is provided "as is" and "as available" without warranties of any kind, either express or implied
  • We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
  • Our total liability for any claims arising from or related to the App shall not exceed the amount you have paid for the App in the 12 months preceding the claim
  • We are not liable for any losses, damages, injuries, or regulatory penalties arising from reliance on AI-generated content without appropriate professional review

9. Indemnification

You agree to indemnify, defend, and hold harmless Site Manager AI, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App, your violation of these Terms, or your use of AI-generated documents without appropriate professional review.

10. Data Protection

We handle your personal data in accordance with our Privacy Policy and applicable data protection laws including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms within the App or by other reasonable means. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Sections of these Terms which by their nature should survive termination shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
